The guilty pleas were entered on January 10, 2012, in the United States District Court for the Middle District of North Carolina, by Roger D. “Butch” Mabe, Jr., 49, and Mabe Trucking Co., Inc., of Eden, North Carolina. “Butch” Mabe, President of Mabe Trucking, also entered the plea on behalf of the corporation.

The Information alleges that Mabe and the corporation engaged in the falsification of driver’s duty status logs for the purpose of concealing from the Department of Transportation’s Federal Motor Carrier Safety Administration the number and times of hours driven as required by Federal Motor Carrier Safety Regulations. These regulations limit the number of hours a truck driver can operate a vehicle and are aimed at preventing motor vehicle accidents caused by driver fatigue. Truck drivers are required to record their duty status on logs to ensure they do not exceed the maximum number of allowable driving hours, and that they receive sufficient rest before driving again. Mabe and the corporation are alleged to have falsified such logs in an effort to exceed these hours of service restrictions and avoid detection by law enforcement.

Sentencing is scheduled for April 20, 2012, in Greensboro. Mabe faces a maximum penalty of up to five years imprisonment, a fine of up to $250,000, and up to three years of supervised release. The corporation may be subject to a fine of up to $500,000 and probation for not less than one and not more than five years.

The charges resulted from an investigation conducted by the U.S. Department of Transportation – Office of Inspector General and the Federal Motor Carrier Safety Administration. The case is being prosecuted by Assistant United States Attorney Cliff Barrett.

Gaston was sentenced as an Habitual Felon to 66-89 months in prison by Judge Stuart Albright.

In July 2011, deputies with the Rockingham County Sheriff’s Department received a complaint that Gaston, a registered sex offender, had set up a Facebook account. The complainant was the victim of a prior sexual assault by Gaston and told deputies that he had sent her a “friend” request despite a no-contact order. Gaston gave a statement to deputies admitting he had the Facebook account for approximately two weeks.

“This case demonstrates the importance of keeping sex offenders off social media sites,” said Julia Wolf Hejazi, Rockingham County Chief Assistant District Attorney. “Victims of sexual assaults have a right to be left alone, and this law helps to protect their privacy.”

Gaston had prior convictions for Assault with a Deadly Weapon Inflicting Serious Injury, Felony Larceny, Indecent Liberties with a Child, Failure to Register as a Sex Offender, Contributing to the Delinquency of a Juvenile, Assault with a Deadly Weapon, Assault on a Law Enforcement Officer, and Burglary.

Williams was sentenced to 90-117 months in prison by Judge Stuart Albright.

On December 29, 2009, Williams sold 20 hydrocodone tablets to an undercover law enforcement officer. SBI lab results revealed that Williams had sold 16.6 grams of the Schedule III controlled substance. Williams was subsequently indicted for Trafficking in Opiates by Possession and Trafficking in Opiates by Sale.

On April 7, 2010, officers with the Madison Police Department were conduction a license check point. During the checkpoint, Williams was a passenger in a vehicle that was stopped and detained, due to an open container of alcohol in the vehicle. According to a release from the Rockingham County District Attorney’s Office, when Williams exited the vehicle, he stumbled and smelled of alcohol. Officers then asked for consent to search Williams, and discovered two rocks of crack cocaine.
